Thataway Terms of Use

Licence

You’re granted a personal, non-exclusive, non-transferable licence to install and use Thataway on devices you own or control, subject to these terms and Apple’s Media Services Terms, which apply to every App Store app. The licence covers use of the app as distributed through the App Store; it does not grant rights in the source code or trademarks.

Routes are guidance only

Routes, turn directions, distances, elevation and climb information come from map data and device sensors that can be incomplete, out of date or wrong. A route may cross private land, closed paths, busy roads or unsafe ground. Obey local laws, signs and closures, respect landowners, and use your own judgment about where it is safe to run. Watch for traffic and keep your attention on your surroundings, not the screen.

Health and training

Thataway is not a medical device. Pain Points, heart rate, pace, power and other training figures are estimates to help you plan training, not medical advice. Check with a doctor before starting or changing an exercise programme, and stop if you feel unwell.

Your data

Your runs, routes, thresholds and settings stay on your devices and in Apple Health, as described in the privacy policy. Abokado Labs can’t recover data that is deleted from your devices or from Apple Health.

Third-party services

Thataway uses services run by others: Apple Health, route planning through Geoapify, maps from OpenFreeMap and MapTiler, elevation from Mapterhorn, and Strava if you connect it. Their terms and privacy policies apply to the data they handle. These services may change, slow down or stop, and route planning may be busy at times.

Thataway is not affiliated with, endorsed by or sponsored by TrainingPeaks or Strava. TrainingPeaks and Strava are trademarks of their respective owners. Apple, Apple Watch, iPhone and Apple Health are trademarks of Apple Inc.

No warranty

Thataway is provided “as is”, without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. No software is free of bugs, and recordings can be incomplete if a device runs out of battery, loses GPS signal or is interrupted.

Limitation of liability

To the fullest extent permitted by law, Abokado Labs is not liable for indirect, incidental, special, consequential or punitive damages, for personal injury or property damage arising from following a route, or for loss of data, revenue or profits, arising from or relating to your use of Thataway. Where liability cannot be excluded by law, it is limited to the amount you paid for Thataway, if any, in the twelve months before the claim. Nothing here excludes rights that cannot legally be excluded.

Apple’s role

These terms are between you and Abokado Labs, not Apple. Apple is not responsible for Thataway, its support or its content. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.

Changes

These terms may be updated. Material changes will be posted here with a revised effective date. Continued use after a change means you accept it.

Governing law

These terms are governed by the laws applicable where you live, to the extent those laws apply to an independent App Store app distributed through Apple’s storefronts. Disputes that can’t be resolved by email should follow the dispute process Apple makes available through the App Store.
